The general purpose of the War Hazards Compensation Act is to shift to the United States the costs of compensation to those engaged in such work and injured by a war risk hazard. Individuals covered also come under a system, which was originally organized under the Longshore & Harbor Workers’ Compensation Act.

Coverage is for injury caused to a qualifying employee which “proximately results from a war risk hazard”. The employees are generally those covered by the Defense Base Act, those covered by the Non-Appropriated Fund Instrumentalities Act, those employed directly by the United States, and those providing welfare or similar services for the Armed Forces of the United States. The injury must occur outside of the United States. The War Hazards Compensation Act also applies where such a person is detained by hostile forces, is missing under circumstances supporting an inference that such absence is due to belligerent action of a hostile force, or is marooned by virtue of failure of the United States or its contractors to repatriate.
