The Defense Base Act includes public works contracts with the government for the building of non-military projects such as dams, schools, harbors, and roads abroad. Today, almost any contract with an agency of the United States government for work outside of the United States, whether of military nature or not, will likely require Defense Base Act coverage. The Defense Base Act also includes employees currently working for the United States or on behalf of the United States of America in Iraq, Afghanistan, Kosovo, Bosnia, Korea and any other locations where these individuals are in support or working on behalf of the United States of America.

Under the Defense Base Act there is no difference for civilian employees whether they are working in a war zone or in any other civilian area as long as the worker who has been injured or dies is not working within the United States of America and is working for a company that is providing services to the United States Defense Department. Individuals working in Iraq, whether providing security, services, transportation services or any other service that in any way relates to the Department of Defense, will be covered by the Defense Base Act. In addition the, individuals working in support of a Defense Department contract anywhere else in the world also will be covered by the Defense Base Act. Thus, individuals working in countries providing any type of support for the Defense Department will be provided coverage. These include individuals working at missile tracking stations on islands; individuals supporting or monitoring any government installations anywhere in the world, except in the United States itself, that are in support of the defense of the United States of America. Individuals covered come under a system, which was originally organized under the Longshore & Harbor Workers’ Compensation Act.
